Abuse, Misuse or Waste of Port Resources Improper or unauthorized use of Port equipment, information, position, property, resources or time for personal gain or for non-Port business reasons. (Examples include: falsification of time records, misrepresentation of actual conditions related to employee benefit plans including abuse of sick or other paid time-off programs, creating unneeded overtime, misusing official position for personal gain, making travel choices that are unnecessarily extravagant or expensive, use of staff time for personal errands, use of Port email for personal business, misuse of confidential information or proprietary information allowing a vendor unfair advantage in the bidding process.)
Accurate Books and Records The unethical systematic recording and analysis of the business and financial transactions associated with generally accepted accounting practices. (Examples include: misstatement of revenues, misstatement of expenses, misstatement of assets, misapplications of GAAP principles, wrongful transactions.)
Badging/Access Control Information to obtain a new or replacement ID badge or to request information to return a former ID badge. Questions regarding unauthorized access, questions, or concerns on the Port of Oakland Access Control System.
Confidentiality and Misappropriation Confidentiality refers to the protection of the Port and our customer's non-public information and use of such information only for legitimate business purposes. Misappropriation refers to the unauthorized or improper use of a third party's intellectual property rights, including patents, trademarks, copyrights and trade secrets.
Conflict of Interest A conflict of interest is defined as a situation in which a person, such as a public official, an employee, or a professional, has a private or personal interest sufficient to appear to influence the objective exercise of his or her official duties. (Examples include: inappropriate customer/vendors relations, bribery, inappropriate contract award without competitive bid process)
Embezzlement To appropriate (as property entrusted to one's care) fraudulently to one's own use. (Examples include: bookkeeping errors, misapplication of funds, and mishandling of cash)
Environmental Protection, Health or Safety Law Violation of any environmental laws and regulations. Failure of meeting requirements needed to perform all duties in a secure environment. Potential areas of harm. (Examples include: environmental damage, mishandling and improper disposal of hazardous materials, violation of OSHA or EPA rules, poor housekeeping)
Falsification of Contracts, Reports or Records Falsification of records consists of altering, fabricating, falsifying, or forging all or any part of a document, contract or record for the purpose of gaining an advantage, or misrepresenting the value of the document, contract or record.
Hiring Irregularities Violation of applicable hiring rules (e.g. civil service rules), evidence of personnel decisions being based on criteria other than an applicant's merit or qualifications.
Improper Giving or Receiving of Gifts The giving, receiving or solicitation of items which could be reasonably interpreted as an effort to influence a business relationship or decision; items given, received or solicited for the benefit of an individual or an individuals family or friends; items given, received or solicited during or in connection with contract negotiations; the acceptance of cash, checks, money orders, vouchers, gift certificates, loans, products, or services.
Nepotism / Favoritism / Inappropriate Workplace Relationships Refers to real or perceived favorable treatment or relationships between employees (such as: a family member being in a position to hire, fire, promote, demote, or influence compensation or the work environment of another family member; inappropriate work relationships during work hours; favoritism of one employee over another; etc.)
Theft The act of stealing; specifically: the felonious taking and removing of personal or Port property with intent to deprive the rightful owner of it.
Violation of Policy Willful or innocent actions that are in direct violation of Port policy, procedures, code of conduct, and/or implied contractual responsibilities.
