	Confidentiality	Improper disclosure of confidential patient information such as HIV/substance abuse or other confidential patient information.
	Healthcare Fraud and Abuse	Violations of MSSP waivers, quality reporting irregularities, diagnosis coding irregularities, cost shifting of care of patients (i.e. referring patients to non ACO providers).
	HIPAA privacy/security	Violation of protected health information privacy or security rules.
	Improper Supplier or vendor activity	Supplier or contractor activity in violation of corporate policies and procedures; improper supplier or contractor selection based on personal gain, improper negotiation or diversion of contract awards.
	MSSP Operating Agreement	Failure to meet CMS’ Medicare Shared Savings Program requirements including conflicts of interest management, reporting to CMS.
	Patient Rights/Patient Care	Failing to provide notice of ACO participation, failure to fulfill other ACO patient rights, use of unapproved marketing materials, etc.
	Physician referrals and payments	Failure to fulfill participation agreement terms, payments for referrals to the ACO, etc.
	Other	All other issues.
