Disclosure of Confidential Information Unauthorized and unlawful disclosure of organization owned information and materials, including intellectual property, trade secrets, employee or member/participant information, marketing and other data bases, marketing plans, business proposals and strategies.
Discrimination or Harassment Uninvited and unwelcome verbal or physical conduct directed at an employee or member/participant because of his or her race, color, creed, religion, gender, sexual orientation, age, national origin, citizenship status, veteran status, marital status, mental or physical disability, or membership in any other class or category protected by applicable federal, state or local law. Also included is any bias in hiring, promotions or assignments and unfair compensation.
Donor Stewardship Funds directed to the organization have not been handled with the utmost truthfulness or not used in accordance with the donor’s intentions and wishes. Failure to provide due care with respect to the donor and/or donation. Injury to the public trust.
Falsification of Contracts, Reports or Records Falsification of records consists of altering, fabricating, falsifying or forging all or any part of a document, contract or record for the purpose of gaining an advantage or misrepresenting the value of the document, contract or record.
Misconduct or Inappropriate Behavior Intentional wrongdoing; specifically, deliberate violation of a law or standard. (Examples include: use of illegal drugs, underage drinking, persons under the influence of drugs or alcohol, unlawful use of YMCA equipment, acts of vandalism, acts of violence or threat of violence).
Risk or Safety Matters Examples include: Child Safety – Any form of child abuse or mistreatment including physical contact, language or gestures that threaten the safety or welfare of a child or teen; a child left unattended or in unsafe surroundings; Aquatic Safety – Lifeguards not focused, properly equipped or rescue ready; General Safety – Failure to meet requirements needed to perform all duties in a safe manner.
Theft The act of stealing; specifically: the felonious taking and removing of personal property with intent to deprive the rightful owner of it.
Violation of Policy Willful or innocent actions that are in direct violation of organizational policy, procedures, codes of conduct, and/or implied contractual responsibilities (Examples include: non-disclosure agreements, hiring standards, safety, Internet usage, organizational guidelines).
