Confidentiality / Data Privacy Confidentiality refers to the protection of the agency’s non-public information and use of information for legitimate business purposes. This category may be used for violations of the Health Insurance Portability and Accountability Act (HIPAA).
Conflict of Interest A situation in which an employee has a private or personal interest sufficient to appear to influence the objective exercise of his or her official duties. (Examples include: inappropriate vendor relations, bribery, misuse of confidential information, inappropriate customer relations) This category also includes the giving, receiving, or solicitation of items which could be reasonably interpreted as an effort to influence a business relationship or decision and/or to benefit an individual’s family or friends.

This category includes but is not limited to misstatement of financial records, employee benefit abuses and/or time abuse.
Health or Safety Law Violation of law, regulation, state or agency policy or procedure with respect to the health and safety of other individuals.
Hostile and/or Offensive Workplace The use of inflammatory, derogatory, unduly critical or insulting communication to another staff member. This category includes but is not limited to offensive sexual advances or sexually offensive remarks or acts; unwelcome verbal or physical conduct directed at an employee based on his or her sex, religion, ethnicity, or beliefs; verbal or physical threat of bodily harm; or improper use of supervisory authority in response to an employee taking action or refusing to take action.
Substance Abuse Substance abuse is defined as the misuse of both legal and illegal drugs including alcohol.
Theft / Embezzelment Stealing; taking and removing personal property with the intent to deprive the rightful owner of it. (Examples include: bookkeeping errors, misapplication of funds, and mishandling of cash).
Violation of State or Agency Policy Willful or innocent actions that are in direct violation of state or agency policy, procedures, code of conduct, and/or implied contractual responsibilities.
