Antitrust/Competition Law Arrangements to gain improper advantages in violation of antitrust and fair competition laws, or company policy. Prohibited activities include, but are not limited to, price fixing, allocation of markets, monopolization, tying arrangements, boycotts, and reciprocal dealings.
Bribery/Improper Payment Offering, promising, giving or soliciting anything of value, directly or indirectly, to improperly influence a person or gain an unfair advantage.
Conflict of Interest Conflicts of interests arise when a personal interest, or the interests of friends or family members, potentially interfere with the employee’s ability to make impartial business decisions on behalf of the company (Examples include: inappropriate vendor or customer relationships; financial interests in competitors, customers and suppliers; outside employment; business relationships with family and friends; corporate opportunities for personal benefit; and accepting inappropriate gifts or entertainment from vendors or customers).
Discrimination or Harassment Discrimination is when someone is treated differently or unfairly because of their race, color, gender, national origin, age, religion, citizenship status, disability, medical condition, sexual orientation, gender identity, veteran status, marital status or any other characteristic protected by law. Harassment is uninvited, unwelcome or inappropriate conduct (whether physical or verbal). Examples of discrimination/harassment include bullying, abuse, offensive jokes/objects/pictures, name calling, assaults, threats, intimidation, unwelcome sexual advances or requests for sexual favors.
Expense Report Irregularities The submission of reports or records which overstate or misrepresent actual expenses or otherwise violate the company travel and expense policies.
Falsification of Contracts, Reports or Records Falsification of records consists of altering, fabricating, falsifying, or forging all or any part of a document, contract or record for the purpose of gaining an advantage, or misrepresenting the value of the document, contract or record.
Human Rights/Modern Slavery The potential infringement of human rights by the company, its suppliers or business partners directly liked to our operations or our business. Potential violations include but are not limited to child labor, human trafficking, unsafe and unhealthy work conditions.
Improper External Financial Reporting Intentional misrepresentations or omissions in reports to governmental authorities, external auditors or other external parties that violate law or company policy.
Privacy Unauthorized or unlawful disclosure or improper handling of employee or other third party personally identifiable information.
Retaliation Retaliation is the act of punishing someone because of action taken. It can include both overt forms (such as demotion, poor performance reviews or public attacks on the employee who raises a concern) and more subtle forms (such as excluding the employee for social events, withholding important job-related information or ignoring the employee’s suggestions).
Sabotage or Vandalism Destruction of an employer's property (as tools or materials) or the hindering of manufacturing by discontented workers (Examples include: Equipment destruction, stealing, work slowdown, computer virus).
Securities Violations/Insider Trading Infringement, transgression; specifically: an infringement of the rules which securities acts define (Examples include: insider trading).
Trade Compliance Violation Actions, omissions, activities or practices that violate export control law or company policy. Prohibited activities include, but are not limited to, unauthorized business with sanctioned countries or parties; participation in trade boycotts; or improper handling of shipments and other transactions, in violation of company policy.
Unprofessional Conduct in the Workplace Workplace incivility is rude, disrespectful or discourteous behaviors in the workplace that result in someone feeling disrespected, intentionally ignored, undermined or belittled.
Unsafe working conditions/ Health and Safety Failure of meeting requirements needed to perform all duties in a secure environment. Potential areas of harm (Examples include: environmental damage, OSHA, EPA, supervisor directive, poor housekeeping).
Violation of Policy or Law Statements, conduct or actions that violate the law, a company policy or the Code of Business Conduct and Ethics that are not otherwise specified in another category.
Violence or Threat Violent behavior or the threat of violence that arises from or occurs in the workplace and/or that affects HF Sinclair or HEP employees.
