EthicsPoint is an independent company that provides secure, confidential telephone and web-based systems for those who wish to report a concern regarding business conduct. Sun Chemical is one of many companies that contract with EthicsPoint for this service in the belief that potential reporters will be more comfortable reporting a concern knowing they will be reporting to a professional, third-party. In addition to providing service 24 hours a day, EthicsPoint offers translation services that allow telephone and web reports to be made in dozens of languages.

What questions or concerns should not be reported using this EthicsPoint service?

This service is for reporting what you believe to be violations of law, violations of the Business Conduct Standard & Guidelines pertaining to suspected fraud and misconduct in respect of accounting, internal accounting controls, auditing matters and bribery, banking and financial crime by employees, agents, or consultants of Sun Chemical. Should I report my concern through EthicsPoint or my Sun Chemical manager?

First consider whether you are comfortable raising your concern directly within Sun Chemical, such as to your manager, your HR representative, someone else in your department, or to Sun Chemical senior management. Sun Chemical has found that internal concerns usually can be resolved most quickly and satisfactorily when they are raised with internal resources such as management or human resources. If you are uncomfortable doing so, if you do not know whom to contact, or if you believe your concern has not been satisfactorily addressed, please proceed with the filing of a report through EthicsPoint. When reporting a concern, it is advised to utilize either a personal telephone or computer (not company owned).

How can I report my concern to EthicsPoint?

Should I identify myself?

If you choose to identify yourself in reporting your concern, Sun Chemical will make every reasonable effort to hold your confidence during the investigation. Many investigations can be more quickly and effectively completed when a reporter is identified because it allows Sun Chemical’s investigator to follow up directly with the reporter.

May I report my concern anonymously?

In all countries except those which prohibit anonymous reporting, you may report your concern anonymously in either the web-based format or through the Sun Chemical Ethics Line, which is operated by EthicsPoint. If you choose to make your report anonymously, you will be provided with a report key and asked to create a password. You will be asked to retain these in order to return to the report you previously submitted. When you check back, you can monitor the investigation on your concern and add additional information, if necessary. This will also allow Sun Chemical to ask follow-up questions while protecting your anonymity.

How does EthicsPoint maintain confidentiality?

EthicsPoint does not trace phone calls or use Caller Identification. In addition, EthicsPoint does not generate or maintain internal connection logs containing Internet Protocol (IP) addresses, so no information linking you to EthicsPoint would be available. Reports from your computer would come through a secure Internet port and does not trace or show user screen names. EthicsPoint will not use information reported to it for any purpose other than passing along the information to Sun Chemical for appropriate handling.

How can I monitor progress of the investigation?

At the end of your telephone call or web-based report, EthicsPoint will provide you with a report key and ask you to create a password. You will be asked to telephone Sun Chemical Ethics Line, operated by EthicsPoint, or log into the EthicsPoint website 7-10 work days after you make the initial report. At that time, you can view progress on your report and learn whether any additional information is needed from you to address your concern.

How does Sun Chemical investigate concerns?

EthicsPoint notifies Sun Chemical ethics department when a concern is received. Sun Chemical then commences an appropriate investigation, using internal or external resources with expertise in conducting investigations. The information in the report is shared with appropriate investigation team members, and the concern is investigated promptly and discreetly. What if I face retaliation?

Sun Chemical strictly forbids any retaliation against any person who reports a concern. Complaints made in good faith do not expose you to any sanctions, regardless of whether the underlying facts prove to be correct or result in any action. If you believe you have faced retaliation of any kind, please report it so that Sun Chemical can investigate.
