You are in doubt whether or not to file an allegation?

The immediate reporting of possible misconduct or unethical behavior allows us as a Company to become aware of situations that threaten our value of integrity, and to evaluate the referral of such report to the respective team in order to initiate a due investigation process. In this manner and depending on the case, the Company may take the necessary actions to resolve the issue reported.

Where and how can I file an allegation relating to a misbehavior?

To report possible misconduct, such as violations of Company policies, you may contact your immediate supervisor, Company manager, Human Capital or Compliance. If you prefer to contact other persons or if you have reported a situation and do not believe it has been investigated or resolved, you may contact the Ethics and Compliance HelpCenter or file your report through this website, Section File An Allegation. The Ethics and Compliance HelpCenter is available 24 hours a day, 7 days a week. The Ethics and Compliance HelpCenter staff do not have caller ID available on their phones, so no matter where you call from, you cannot be identified. The HelpCenter website does not track computer names or IP addresses, so online allegations cannot be traced to any particular person.

What should I disclose in the allegation?

The Organization expects its employees and third parties to report any non-compliance with our laws, rules, internal regulations, policies and procedures, or misconducts. Employees or third parties who become aware of any situation that may jeopardize the Organization's integrity and reputation must report the facts immediately.

Can disciplinary actions be brought against me if I file an allegation for misbehavior?

No, as long as the allegation is filed in good faith. The Organization has established a non-retaliation policy, pursuant which the Company will not take disciplinary action against a person reporting irregularities or participating in an investigation, to the extent that the report is made in the spirit of "good faith" collaboration.

If I have taken part in misbehavior, can I self-report my own misconduct?

Yes, you may file a self-report. In this regard, the Company will consider conducting an investigation within the framework of a due process. In this regard, where appropriate, the Organization cannot guarantee that disciplinary action will not be taken for your actions, but will take into consideration the fact that you have self-reported, which may result in a less stringent disciplinary action.

Please note that failure to report misconduct is in itself a violation of our Company's policies.

Where can I inquire about whether there is a Company policy associated to a specific issue or how a specific policy is applied?

You may contact the Compliance Auditor or the Compliance Officer in your Organization by e-mail at epd@banmedica.cl, or if you prefer, you may call the Ethics and Compliance HelpCenter, who will be able to provide you with guidance and/or information in this regard.

What happens when I get in touch with the Ethics and Compliance HelpCenter?

The Organization has contracted with an outside call center service, EthicsPoint. EthicsPoint personnel are trained to ask questions that will help provide the Company with information necessary to conduct an investigation and, if appropriate, resolve the issues you report.

EthicsPoint staff will not be able to answer your questions or resolve any issues on your initial call. They will prepare an online report based on the information you provide and forward it to the Organization's Compliance area. When you report an irregularity or issue, you will be assigned an allegation code and password. It is essential that you keep the report code and password, as this is the only way you will be able to follow up on the status of your allegation, supplement the information provided or answer any questions that may be asked by the Compliance area.

Can I file allegations anonymously?

Yes, you may file an allegation anonymously.

If you do so, the Organization will take all necessary steps to protect your identity. Your call will not be recorded, and we will not know the number or location of the caller. If your report is made through this website, please be advised that this site is secure and protected by the latest encryption technology. However, there are some considerations you should be aware of:

  • People may find out that you filed a report, for example, if you report another employee for misconduct, it is very likely that we will ask that person for his or her version of the events. Obviously, sometimes the person may intuit who filed the report.
  • Also, if you do not identify yourself, we may not be able to respond adequately to your allegation or investigate it, unless you provide us with a channel through which we can communicate and obtain further information.
  • If you wish, you may identify yourself and ask us to keep your information confidential, and we will take steps to keep your identity confidential. However, we may not be able to do so if a court requires us to provide information about your case and, again, individuals may be able to determine who filed the complaint. The Organization has a non-retaliation policy that prohibits disciplinary action against you solely for making good faith reports of possible improper, unethical or unlawful conduct.

We will try to be clear with you about how we respond to your allegation. However, for reasons of confidentiality and privacy, you should be aware that we may not always be able to tell you what action the Organization has decided to take.

What happens once an allegation has been filed?

All allegations received that are related to non-compliance with laws, rules, internal regulations, policies and procedures or misconduct, will be investigated pursuant to the internal procedure.

All online calls or allegations received through the HelpCenter are submitted to the Compliance area, which evaluates whether an investigation is necessary. If so, and depending on the type of allegation, the Compliance area will either handle the investigation or refer the case to the appropriate team. Many of the calls involve human resources issues, so they will be referred to the appropriate Human Capital area. They may also be referred to Medical, Legal or other departments as appropriate.

What are the media through which I can attach information associated to the alleged facts?

How long will the investigation of an allegation take?

The Organization takes the allegations filed seriously and committedly; that is why it has established an average term for the resolution of an allegation of no more than 30 days. However, depending on the complexity of the process, sometimes an investigation will require more time than expected. If this is your case we will inform you about it.

When will I know the results of the investigation?

At the end of the investigation, the Company will normally notify you through the HelpCenter that the investigation has been completed and that appropriate action has been or will be taken. In accordance with our confidentiality and privacy policies, in some cases, you will not receive details of the findings of the investigation, nor of any action taken, including any disciplinary action against an employee for violations of law, rules, internal regulations, policies and procedures or misconduct. If you believe that the problem continues, we request that you contact Compliance again.
