Why has UPS contracted with EthicsPoint for reporting of Ethics concerns?

EthicsPoint is an independent company that provides secure, confidential telephone and web-based systems for use by those who wish to report a concern regarding business conduct. UPS is one of many companies that contracts with EthicsPoint for this service in the belief that potential individuals will be more comfortable reporting a concern if they know they will be reporting to a professional, third-party. In addition to providing service 24 hours a day, EthicsPoint offers translation services that allow telephone and web reports to be available in various languages.

What is the role of EthicsPoint?

    EthicsPoint's principal responsibilities are to:

  • Provide confidential telephone and web-based options for employees and others to report ethics and Code of Business Conduct concerns
  • Provide translation services for those reporters who wish to report in languages other than English
  • Transmit information about the concern to the UPS Corporate Compliance & Ethics team so that UPS can take appropriate action.
  • Allow a reporter to anonymously communicate with UPS investigators by serving as an intermediary which can relay follow-up questions and answers, as well as information about the resolution of the case.
  • It is not EthicsPoint's role to take action to address the concern, only to transmit the concern to the UPS Corporate Compliance & Ethics team.

How do I report a potential violation using this website?

    To file a report using the website:

  1. Select “File a Report” from the UPS Ethics Hotline webpage: www.UPSEthicsHotline.com.
  2. Select the Country you are reporting from.
  3. Select an issue type that best describes your area of concern.
  4. Fill out a report on the potential violation by answering the questions provided.
  5. Record the unique report key and password for your report so that you can return later to check progress or answer questions about your report.

What should I do if I lose my report or password?

Due to the high level of security that is maintained for these reports, if you lose your report key or password, you will need to fill out a new report. When filing the new report you should mention that it is related to a report you previously filed.

What happens when I file a report using the UPS Ethics Hotline?

    When the UPS Ethics Hotline is contacted, the following actions may be taken:

  • A report will be forwarded to the appropriate UPS management person(s) for review and follow-up.
  • The concern will be reviewed by members of management that may include representatives from Corporate Compliance and Ethics, Human Resources, Corporate or Region Legal, Security, or Internal Audit. If the inquiry is one that can be properly investigated by someone in the region, district, or business unit, it will be referred there for evaluation and resolution. Each concern will be carefully evaluated before it is referred for investigation and appropriate remedial action.
  • The concern will be handled promptly, discreetly, and professionally. Discussions and inquiries will be kept in confidence to the extent possible or permitted by law.
  • Certain follow-up information about how the concern was addressed may be available by the individual reporting the concern upon his or her request.

Should I report my concern to my manager, Human Resources, Security or through the UPS Ethics Hotline?

When you have a concern or observe behavior that you believe violates Company policy, the Code of Business Conduct or the law, you are expected to report it. Employees may communicate their concerns by speaking to their direct manager or supervisor, by using the Open Door Policy to talk to someone else in management, including their Human Resources manager, or someone from the function with the expertise and responsibility to address the concern. Employees may also report concerns anonymously by using the UPS Ethics Hotline. Any known or suspected potential acts of fraud by UPS employees, contractors, vendors and/or any other outside parties should be immediately reported to the UPS Ethics Hotline.

What if this is an emergency?

If you have a life-threatening emergency and require immediate assistance, please contact 911 or your local emergency services.

Should I identify myself?

It is usually easier to conduct a more complete investigation if you identify yourself and those involved because it allows the UPS investigator to directly follow-up with you and others. If you choose to identify yourself in reporting your concern, UPS will make every reasonable effort to hold your name in confidence during the investigation. No employee or representative of UPS will be disciplined, lose a job or contract, or be retaliated against in any way for asking questions or voicing concerns about our legal or ethical obligations when acting in “good faith.” Good faith does not mean an individual has to be right; but it does mean that the individual must believe that the information provided is truthful.

Can I report my concern anonymously?

You may report your concern anonymously by using the UPS Ethics Hotline – online or by phone, which are operated by EthicsPoint. If you choose to file your report anonymously, you will be provided with a report key and asked to create a password. You will need to retain the report key and password to the report you previously submitted. When following up on your report, you can add additional information if necessary or inquire about status. This also allows UPS to ask follow-up questions, while protecting your anonymity. Keep in mind that follow up is important for anonymous reports since we have no other means to communicate with you.

How does EthicsPoint maintain anonymity?

EthicsPoint does not trace phone calls or use Caller Identification. In addition, EthicsPoint does not generate or maintain internal connection logs containing Internet Protocol (IP) addresses, so no information linking your computer to EthicsPoint would be available if you choose to make a report online. Reports from your computer would come through a secure Internet portal which does not trace or show user screen names.

How can I monitor progress on my concern?

At the end of your telephone call or web-based report, EthicsPoint will provide you with a report key and ask you to create a password. You will be asked to telephone the UPS Ethics Hotline, operated by EthicsPoint, or visit the Ethics Hotline website periodically after you make your initial report. At that time, you can learn whether any additional information is needed from you to address your concern.

What if I face retaliation?

No employee or representative of UPS will be disciplined, lose a job or contract, or be retaliated against in any way for asking questions or voicing concerns about our legal or ethical obligations when acting in “good faith.” Good faith does not mean an individual has to be right; but it does mean that the individual must believe that the information provided is truthful. If you believe you have faced retaliation, please report it through the UPS Ethics Hotline so that UPS can investigate.

How does UPS investigate reports?

EthicsPoint notifies UPS Corporate Compliance & Ethics when a report is received. The Company will review each report and take appropriate remedial action as required. In some instances, the Company may need to request additional information. Once the report is filed, UPS reviews the details and involves the appropriate team (i.e., Human Resources, Legal, IT, Finance, Security) to conduct the investigation. Investigations are conducted timely and with a focus on confidentiality.

Where do these reports go?

Reports are entered directly on the EthicsPoint secure server to prevent any possible breach in security. EthicsPoint makes these reports available to the UPS Corporate Compliance and Ethics team to review.

What if I have an issue with my paycheck or compensation?

In order to view your current paycheck and previous paychecks, visit www.upsers.com. If you experience an issue with your paycheck, it is recommended that you first contact your immediate manager or local HR representative.
